Walk into the wrong classroom demo and you might see a kid wearing an EEG headband that turns red when their mind wanders and blue when they’re locked in. The pitch sounds almost reasonable: teachers get real-time feedback on who’s actually absorbing the lesson, and students get help before they fall behind. The reality is messier. Neurotech has genuinely reached a tipping point as an industry, but “brain data in schools” covers two very different things wearing the same marketing language: legitimate clinical neurofeedback with real trial data behind it, and consumer-grade attention-scoring hardware with almost none. Confusing the two isn’t just sloppy. It’s the whole reason this debate keeps generating more heat than light.
The headband that started the backlash
The device most people picture when they hear “neurotech in schools” is BrainCo’s Focus1, sold to institutions as Focus EDU: an EEG headband plus a teacher-facing dashboard that scores each student’s attention from 0 to 100 and flags the lowest scorers in real time. BrainCo, founded in 2015 and incubated at the Harvard Innovation Lab, rolled the system out to Chinese classrooms starting around 2017. By the time EdSurge and CSO Online covered the story, the company was aiming to build what it called the world’s biggest brainwave database from 1.2 million students, and it didn’t have a published privacy policy while doing it. A privacy attorney interviewed at the time noted that under COPPA, a company collecting children’s data needs clear procedures for deletion and disclosure. BrainCo had neither in place, and its CEO didn’t respond to questions about it.
The predictable blowup came in 2019, when Focus headbands worn by pupils at a primary school in Zhejiang province were shown scoring children’s attention for teachers, and, per Rappler‘s reporting, the local education bureau halted the trial after public backlash. BrainCo maintained the devices were only used in a research trial and had never been sold to a public school. That distinction mattered less to parents than the image of a classroom full of children ranked by a red-yellow-blue light on their foreheads. This wasn’t a research paper, and it wasn’t cleared medical hardware either. It was a consumer product deployed at classroom scale with essentially no regulatory floor underneath it, which is exactly the category this industry keeps stumbling into.
Who’s actually behind the headband
Here’s where the story gets more complicated than a single bad PR cycle. A September 2025 investigation by Hunterbrook Media found that BrainCo, which brands itself as a Harvard-founded company, has for nearly a decade been backed by Chinese government-linked entities, including China Electronics Corp, while collecting neural data from schoolchildren and, separately, from U.S. Olympic athletes. Harvard told Hunterbrook it had “identified no indication” that BrainCo ever had access to the university research database its founder, Bicheng Han, has claimed to draw from. That’s not a minor branding exaggeration. It’s a company whose entire market pitch rests on an academic pedigree its namesake institution says it can’t verify.
BrainCo hasn’t gone away since. According to a recent TheNextWeb profile, the company has raised roughly $280 million, co-led by IDG Capital, and filed confidentially for a Hong Kong listing, pivoting its pitch toward consumer wearables generally rather than classroom dashboards specifically. The framing in that piece is the sharpest summary of the actual problem: neural data is uniquely intimate, and the technology that’s easiest to wear onto a child’s head is also the easiest to deploy on people who never meaningfully consented to it. A headband is not a brain implant. Nobody is drilling into anyone’s skull. But that’s precisely what makes it so easy to hand out to an entire classroom without anyone stopping to ask whether they should.
The version of this that’s actually backed by evidence
None of this means brain-based tools have no place near a classroom. It means the legitimate version looks almost nothing like Focus1, and this industry does itself no favors by letting the two get lumped together.
Neurofeedback, used clinically for ADHD, has a real evidence base behind it. The American Academy of Pediatrics has rated it “Level 1 best support” as an evidence-based treatment for childhood ADHD, and a school-based sustained-attention trial found that 71% of participating students showed measurable growth in sustained attention, a figure the researchers noted is roughly in line with the 70 to 90% clinical efficacy typically reported for stimulant medication. That said, I’d push back on treating this as settled science. Other meta-analyses have found the effect mostly disappears once you rely on teacher ratings that are actually blind to which kids got treatment, rather than parent ratings that aren’t. This is a real, ongoing scientific debate, not a marketing claim, and any school piloting it should say so out loud.
Separately, researchers at Kansas State University ran the Muse meditation headband, made by Interaxon, with more than 400 eighth-graders and reported a reduction in classroom behavior referrals. Muse and clinical neurofeedback share hardware DNA with Focus1: EEG sensors, real-time feedback. What actually separates them is purpose and consent structure. One is a targeted intervention, opted into individually, usually alongside a clinician or a documented protocol. The other is a whole-classroom surveillance dashboard nobody specifically asked for. If you’re evaluating any of the devices in this space, that distinction should be the first question you ask, not an afterthought.
Which raises an obvious question for anyone reading this as a parent: would you actually want your kid’s teacher to see a real-time attention score, even if the underlying science were solid? 🧠
The law hasn’t caught up, and it says so itself
Here’s the part that should worry people more than any single vendor. FERPA, the main federal student privacy law, defines “biometric record” to include fingerprints, retina and iris patterns, voiceprints, DNA sequence, facial characteristics and handwriting, a definition written in 2008 regulations that predates consumer EEG entirely. Per EPIC’s tracking of the statute, brainwave data isn’t cleanly covered by that list, which means a school’s FERPA compliance program can be fully up to date and still say nothing meaningful about a headband reading a student’s brain activity. COPPA covers online data collection from children under 13, but a classroom hardware deployment isn’t squarely an “online service” in the way the statute was written to address.
Congress has noticed the gap, at least on paper. In September 2025, Senators Cantwell, Schumer and Markey introduced the MIND Act, directing the FTC to spend a year studying how neural data should be regulated, and explicitly instructing the agency to identify gaps in the protection of children and teens specifically, alongside education as a named sector of concern. Four states, Colorado, California, Montana and Connecticut, have already added neural data to their privacy statutes as a sensitive category requiring consent. None of those laws were written with a classroom in mind, and none of them tell a school district what to do when a vendor shows up offering a free pilot program with a signed permission slip buried in the fine print.
Lily Li, a data-privacy attorney who’s tracked BrainCo’s education pitch closely, told GovTech in June that a lot of the neural data collection in schools looks wildly overblown relative to any real personalized-learning benefit. I think that’s the honest read. A field that talks constantly about ethics and trust, the same themes that show up in what actually differentiates neurotech companies as businesses, keeps shipping products into classrooms faster than any regulator, or frankly any parent, can evaluate them.
What to actually ask before a headband comes home in a backpack
If a school, a district, or an after-school program is piloting anything that touches a child’s brain activity, a few concrete questions separate a defensible pilot from a liability:
Is this a clinical intervention with documented protocol and individual consent, or a whole-classroom dashboard applied to every student by default
Who owns the resulting data, where is it stored, and does the vendor’s privacy policy exist at all, in writing, before a single headband ships
Does the vendor’s home jurisdiction or ownership structure raise questions about where this data could eventually end up
Is a parent able to review, and actually delete, their child’s neural data on request, not just in theory but through a working mechanism
Would the district accept the same product and pitch from a company outside neurotech, or is the “brain science” branding doing work the actual evidence doesn’t support
Ask a vendor these questions directly and watch how fast the pitch changes tone. That reaction alone tells you most of what you need to know about whether the product was built for your kid’s benefit or for a database somebody else wanted to build.
